There is no reason to massclaim when known scum exists and isn't being lynched. The fact that he's still alive shows that scum has captured the town, which means that any massclaim would work to scum's advantage. The only way to avoid this would be if the confirmed town randomly dictated an order, but he's apparently not willing to do that.
