Actually, that situation isn't a lock for the scum, even if there's a no-lynch:

Mafia attacks vig.
Vig attacks mafia.
Doc protects vig.

Next day is vig, doc, mafia. Vig and doc lynch maf.

And even if the mafia target doc in mith's situation, the town can still get an obliteration draw.

Also, there's been at least one game (Mini 12, I think) called in favor of the town. (A recruiting mason group gained a majority of the town.)

I haven't seen that many "unkillable" roles, though I have seen ones that are immune from some nightkills (generally in games with multiple scumgroups), or are immune from lynching, but rarely both.

I generally phrase the scum win conditions as some variant of "You win when all non-members of your group are dead, and at least one member survives.", but will call the game when the town cannot defend against a simple bloc vote by the scum. (For example, a doctor or roleblocker, plus a postblocker or votechanger can allow a town to survive even when outnumbered.)
